The HOA meeting notice plays a crucial role in keeping homeowners in the loop and increasing attendance. That said, there are certain legal standards that boards must meet when it comes to notice delivery and timing. It is important to understand these requirements to avoid potential liability.

Within the context of an HOA or condominium, a meeting notice is a formal communication that the board sends to community residents. This notice announces that there is an upcoming meeting and outlines the pertinent details of that gathering.

 

Meeting notices are critical for maintaining transparency. Homeowners have a right to attend association and board meetings. Without this notice, owners would not know where and when the meeting will take place.

 

HOA Meeting Notice Requirements for Condominiums

The exact requirements for an HOA meeting notice will depend on state laws and the governing documents. In Illinois, condo associations are governed by the Illinois Condominium Property Act. Meeting notice requirements can be found under 765 ILCS 605/18765 ILCS 605/18.4, and 765 ILCS 605/18.5.

 

HOA Board Meeting Notice

According to Illinois law, the board must give notice of every board meeting at least 48 hours before the meeting. The board must post this notice in entranceways, elevators, or other conspicuous places in the condominium. Additionally, the board must give at least 48 hours’ notice to unit owners who authorized electronic notice delivery.

 

If there is no common entranceway for seven or more units, the board may designate nearby locations where they will post the notice. Similarly, the board members themselves must also receive at least 48 hours’ notice, unless they waive this right.

 

HOA Budget Meeting Notice

A budget meeting is different from a regular board meeting. If the board intends to adopt a proposed annual budget or discuss/vote on regular dues or special assessments, there are special meeting notice requirements.

 

For this type of meeting, unit owners must receive notice in the same manner used for membership meetings. This means that the board must generally provide notice no less than 10 days and no more than 30 days before the meeting.

 

In addition to this, there is also a separate requirement that each unit owner must receive a copy of the proposed annual budget. They must receive this copy at least 25 days before the board adopts it.

 

HOA Annual Meeting Notice

Associations must hold an annual meeting based on Illinois law and their governing documents. Board elections usually take place at this meeting.

 

For any membership meeting, including the annual meeting, the board must provide written notice via mail or delivery at least 10 days and no more than 30 days before the meeting. This notice must include the time, place, and purpose of the meeting.

 

Electronic notice is also an option, but only if the governing documents allow it or if the unit owner consents to it.

 

HOA Special Meeting Notice

A special meeting is a meeting that takes place outside of the regularly scheduled ones. In Illinois, the president, the board, or 20% of the unit owners may call for a special meeting. In any case, notice must be provided at least 10 days and no more than 30 days before the meeting.

Common interest communities differ from condominiums in ownership, structure, and governing law. In Illinois, HOAs must adhere to the Illinois Common Interest Community Association Act. The HOA meeting notice requirements can be found under 765 ILCS 160/1-30 and 765 ILCS 160/1-40.

 

Annual and Membership Meetings

Associations must hold an annual membership meeting. This is where the board elections typically happen. For such meetings, the board must provide notice at least 10 days but no more than 30 days before the meeting. This notice must indicate the time, place, and purpose of the meeting.

 

Special membership meetings must also follow the same notice requirement. For HOAs, a special meeting may be called by the president, the board, 20% of the membership, or any other method that the governing documents allow.

 

Regular Board Meetings

In general, board meetings must be open to all owners. Homeowners have the right to attend, but they don’t usually have the right to vote on board business. They can simply observe and provide comments during a designated portion of the meeting.

 

According to Illinois law, the board must give owners notice of all board meetings at least 48 hours in advance. The association may provide this notice through the prescribed delivery method, such as mail and email, or by posting it in common areas.

 

Furthermore, the board must reserve a portion of each board meeting for owner comments. The board may determine how long the comment period lasts and when it can take place during the meeting.

 

Board Meetings Concerning Budgets and Dues

There is a special notice rule for meetings where the board will consider the proposed annual budget, regular dues, or special assessments. Since these involve community finances, HOA meeting notice requirements are stricter.

 

For these meetings, the board must provide notice at least 10 days but no more than 60 days in advance. This is a much longer notice period than the standard 48-hour board meeting notice requirement. It gives homeowners more time to consider the meeting and include it in their schedules.

 

Can an HOA Send Electronic Meeting Notices?

Electronic notices can help reduce costs and waste for the association. Yet, whether or not it is even permitted will depend on state laws and the governing documents.

 

In Illinois, 765 ILCS 605/18.8 and 765 ILCS 160/1-85 address electronic notices for condo associations and HOAs, respectively. According to these laws, associations may deliver notices using acceptable electronic or technological means, including email.

 

The caveat is that the owner must have provided authorization to receive electronic communications from the association. If an owner has not given consent, the association must provide notice by non-electronic means at the association’s expense.
